THERE ARE NO WARRANTIES, EXPRESSED OR IMPLIED.

ONCE YOU SUBMIT PAYMENT THERE IS NO WAY TO BE REFUNDED.

DESIGN GUIDELINES: IF SUBMITTING YOUR OWN DESIGN(S), YOU ARE WHOLLY LIABLE FOR THE FINAL PRINTED QUALITY OF YOUR DESIGN. IF CHOOSING PROFESSIONAL DESIGN AND COPYWRITING SERVICES FROM THEBANDPRESSKIT.COM, THERE ARE NO GUARANTEES OR WARRANTIES, EXPRESSED OR IMPLIED, THAT YOU WILL BE SATISFIED WITH THE FINAL DESIGN. YOU WILL BE RESPONSIBLE FOR SUPPLYING INITIAL DOCUMENTS, INCLUDING IMAGES, LISTS, INFORMATION, CONTENT, COPY AND ANYTHING ELSE REQUESTED BY THEBANDPRESSKIT.COM AND ITS DESIGNERS, WITHIN TEN (10) DAYS OF REQUEST. YOU WILL BE GIVEN AN INITIAL CONCEPT AND UP TO BUT NOT EXCEEDING THREE (3) REVISIONS. AFTER THE THIRD REVISION, ALL DESIGNS AND COPY AND CONTENT ARE FINAL, AND THIS IS HOW YOUR PRESS KIT WILL BE PRINTED. WORK WITH YOUR DESIGNER AND COPYWRITER FOR BEST RESULTS.

THEBANDPRESSKIT.COM HAS THE FINAL SAY IN ANY DISPUTE.

The balance is due on upon order placement.

Collection Costs:

You agree to pay attorney fees, collection fees, court costs and any other expenses incurred in collecting any charges under this agreement or otherwise enforcing the terms of this contract.

Return Check Policy:

There is an NSF charge of $30 for any returned checks.

Ordering Policy/Shipping:

We can’t guarantee your delivery will be on the day specified because we are at the mercy of UPS and other shipping entities.

Responsibility for Use and Disclaimer of Warranties:

You are responsible for the use of the items purchased or rented. You assume all risk inherent in the operation and use of the item(s) and agree to assume the entire responsibility of the defense of , and to pay, indemnify and hold Dealer harmless from, and hereby release Dealer from any and all claims for damage to property or operation or possession of the item(s), whether or not it be claimed or found that such damage or injury resulted in whole or in part from Dealer’s negligence, from the defective condition of the item(s) or from any cause. You agree that no warranties, expressed or implied, including merchantability or fitness for a particular purpose have been made in connection with the purchased items or rented equipment.

This Agreement shall all be governed and construed in accordance with the laws of The State of Ohio. You agree that any legal action or proceeding between thebandpresskit.com and you for any purpose concerning this Agreement or the parties' obligations hereunder shall be brought exclusively in a federal or state court of competent jurisdiction over Shelby County, OH. Any cause of action or claim you may have with respect to the Service must be commenced within one (1) year after the claim or cause of action arises or such claim or cause of action is barred. thebandpresskit.com's failure to insist upon or enforce strict performance of any provision of this Agreement shall not be construed as a waiver of any provision or right. Neither the course of conduct between the parties nor trade practice shall act to modify any provision of this Agreement. thebandpresskit.com may assign its rights and duties under this Agreement to any party at any time without notice to you.
